This website is operated by Tree Pals LLC. Throughout these Terms of Service, “Tree Pals,” “we,” “us,” and “our” refer to Tree Pals LLC.

Tree Pals operates this website and provides its related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with the policies referenced below, explain your rights and responsibilities when using the Services.

By visiting our website, using the Services, or purchasing something from us, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not access or use the Services.

1. Eligibility and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian to use the Services.

You may be asked to provide information such as your email address, billing information, payment information, and shipping address. You agree that all information you provide is accurate, current, and complete and that you are authorized to provide it.

You are responsible for maintaining the security of your account credentials and for activity occurring through your account. You may not sell, transfer, assign, or license your account to another person.

2. Products

We make reasonable efforts to display and describe our products accurately. However, colors and other aspects of a product’s appearance may vary depending on your screen, device, lighting, and settings.

Because products may be manufactured individually, minor cosmetic variations may occur. These variations do not necessarily affect the product’s intended function.

Product descriptions, availability, features, and prices may be changed without notice. We reserve the right to discontinue a product or limit the quantity available to any person, household, geographic region, or jurisdiction.

Unless expressly stated otherwise, air fresheners and other accessories shown in photographs are not included with the Tree Pal.

Tree Pals is an independent business and is not affiliated with, endorsed by, or sponsored by Little Trees or its owners. Any third-party names or trademarks are used only to describe product compatibility.

3. Product Use and Safety

You are responsible for using products according to their intended purpose and any instructions provided.

When using a Tree Pal in a vehicle, ensure that it does not obstruct the driver’s view, interfere with vehicle controls, or create a distraction. Do not install, remove, or adjust the product while driving.

Tree Pals is not responsible for damage or injury resulting from misuse, improper installation, unauthorized modification, or use inconsistent with the product’s instructions.

4. Orders

Submitting an order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including because of product availability, pricing errors, suspected fraud, payment problems, or unauthorized resale.

An order is not accepted until payment has been processed and we provide confirmation. Please review your order carefully before submitting it because we may be unable to change or cancel it after processing begins.

If we change or cancel an order, we may contact you using the email address, billing information, or phone number supplied during checkout.

Products purchased through our website are intended for personal or household use and may not be purchased for unauthorized commercial resale.

5. Prices, Payments, and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when your order is submitted, subject to correction of obvious errors.

Listed prices do not include applicable taxes. Standard shipping to eligible U.S. addresses is included at no additional charge unless stated otherwise. Additional charges may apply for reshipment when an incorrect or incomplete address is provided.

You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the payment method submitted and agree to pay all applicable charges associated with your order.

Promotions may be governed by additional terms. If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

6. Shipping and Delivery

Order processing times and delivery dates are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, holidays, incorrect addresses, customs processing, and circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Please review our Shipping Policy for additional information.

7. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, and order cancellations are governed by our Refund Policy.

Please contact us before returning a product. Approved returns will include instructions and, when applicable under our Refund Policy, a prepaid return label.

8. Intellectual Property

The Services and their content—including our branding, product designs, text, graphics, photographs, videos, logos, and website design—are owned by or licensed to Tree Pals and are protected by applicable intellectual-property laws.

You may use the Services only for lawful, personal, and noncommercial purposes. You may not reproduce, distribute, modify, republish, sell, exploit, or create derivative works from our content without prior written permission.

Nothing in these Terms grants you a license or ownership right in any Tree Pals, Shopify, or third-party intellectual property. All rights not expressly granted are reserved.

9. Optional Tools

We may provide access to tools, applications, or services operated by third parties. We do not necessarily monitor or control these tools.

Third-party tools are provided on an “as available” basis. Your use of them is subject to the applicable provider’s terms and privacy practices. You should review those terms before using a third-party tool.

New features or tools added to the Services will also be subject to these Terms.

10. Third-Party Links

The Services may contain links to third-party websites or services. We are not responsible for evaluating or guaranteeing their content, accuracy, security, products, policies, or practices.

Accessing a third-party website is at your discretion. Questions or complaints regarding a third-party product or service should be directed to that third party.

11. Relationship With Shopify

Tree Pals is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Tree Pals.

Shopify is not the seller of Tree Pals products and is not responsible for transactions between you and Tree Pals or for any injury, damage, or loss arising from a Tree Pals product.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from your transactions with Tree Pals.

12. Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Certain information is also processed by Shopify according to the Shopify Consumer Privacy Policy.

Because Shopify hosts the Services, information you submit may be transmitted to Shopify and other service providers, including providers located outside your state or country.

13. Reviews, Feedback, and Submissions

If you submit a review, photograph, suggestion, idea, or other content (“Feedback”), you grant Tree Pals a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, and distribute that Feedback for operating, improving, and promoting the Services.

You represent that you own or have permission to submit the Feedback and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

Feedback must not contain unlawful, abusive, defamatory, obscene, misleading, or malicious material. You may not submit content containing malware or impersonate another person.

We may monitor, edit, reject, or remove Feedback, but we are not obligated to do so. Unless otherwise agreed, we are not required to keep Feedback confidential, pay compensation for it, or respond to it.

14. Errors and Inaccuracies

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We reserve the right to correct errors, update information, or cancel an affected order. If an order is canceled after payment, the applicable amount will be refunded.

15. Prohibited Uses

You may not use the Services:

For an unlawful, fraudulent, or malicious purpose.
To violate applicable laws or another person’s rights.
To infringe intellectual-property rights.
To harass, abuse, threaten, defame, discriminate against, or harm another person.
To submit false or misleading information.

To interfere with or circumvent the security or operation of the Services.
To copy, scrape, extract, resell, or exploit the Services without authorization.

We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated.

16. Termination

We may suspend or terminate your access to all or part of the Services if you violate these Terms or if continued access presents a security, legal, or operational risk.

Obligations and liabilities incurred before termination will survive. Provisions that by their nature should continue—including provisions regarding intellectual property, feedback, disclaimers, liability, indemnification, and governing law—will remain effective.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products offered through the Services are provided “as is” and “as available,” except for rights or warranties expressly provided by us or guaranteed under applicable law.

We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Tree Pals and its owners, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages—including lost profits, lost revenue, lost data, or replacement costs—arising from your use of the Services or products purchased through the Services.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tree Pals, Shopify, and our respective affiliates, employees, agents, contractors, service providers, and licensors from third-party claims, losses, or reasonable legal expenses arising from your material violation of these Terms, applicable law, or another person’s rights.

20. Severability

If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that portion will be enforced to the fullest extent permitted and treated as severed from the remaining Terms. The remaining provisions will continue in effect.

21. Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies referenced within them constitute the entire agreement between you and Tree Pals regarding your use of the Services and replace prior agreements concerning that use.

22. Assignment

You may not transfer or assign your rights or obligations under these Terms without our written permission.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale, restructuring, or other lawful business transaction.

23. Governing Law

These Terms and any separate agreement through which we provide Services are governed by the laws of the State of North Carolina and applicable federal laws of the United States, without regard to conflict-of-law principles.

Any dispute that may properly be brought in court will be subject to the jurisdiction of the appropriate state or federal courts located in North Carolina, except where applicable consumer law provides otherwise.

24. Changes to These Terms

We may update these Terms periodically to reflect changes to the Services, our business practices, or legal requirements.

The current version will be available on this page. Material changes will be communicated when required by law. Continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms.
